as the context requires as defined in the Companies Act 1965.
"Packet One Services" means all the services offered by Packet One.
"Customer" means the principal account holder for the Packet One Services.
All products and services of Packet One herein provided are subject to the terms
and conditions of the applicable agreements governing their use. These terms and
conditions are meant to regulate Customer's access to this payment page and they
are to be read together with the applicable terms and conditions governing any transaction(s),
product(s) and/or service(s) provided in this website. In the event of conflict
between these terms and conditions and the terms and conditions governing the relevant
transaction(s), product(s) and/or service(s) provided herein, the latter will prevail.

Law and Jurisdiction
These terms and conditions are governed by and are to be construed in accordance
with the laws of Malaysia. By accessing this website and/or using the services provided
herein by Packet One, Customer hereby consents to the exclusive jurisdiction of
the Malaysian courts in Kuala Lumpur, Malaysia in all disputes arising out of or
relating to the use of this website.
Packet One makes no representation that the materials, information, functions and/or
services provided on this website are appropriate or available for use in jurisdictions
other than Malaysia.
TERMS & CONDITIONS OF PAYMENT
- Customer must be the legitimate holder of the credit card that Customer is using
to make payment for the Packet One Services.
- All payments must be made by Customer with Customer's own credit card. Payment shall
not be made by third parties on behalf of Customer. In this regards Customer will
be considered the principal account holder for the Packet One Services.
- Customer can only use this Payment service if Customer holds a VISA or MasterCard
credit card issued to Customer by a financial institution.
- Packet One and the participating Banks will not be liable for any Packet One Services
- Customer gives permission to Packet One:
- to release Customer's details, including Customer's information to the banks for
VISA, MasterCard; and
- to automatically debit the Packet One Services payment amount to Customer's credit
- The payment amount will be automatically debited to the customer's credit card once
the relevant issuing banks/financial institutions have approved it.
- If Customer's credit card is rejected by the banks/financial institutions, Packet
One will inform Customer immediately via a pop up notification screen. However,
Packet One and the Banks will not be liable for any claims, demands, disputes or
losses resulting from Customer's rejected credit card.
- While making on-line payment, if there is a disruption or interruption in the Packet
One Services due to website being down, whether due to Packet One or due to external
factors and third parties' actions, omissions and negligence, Packet One shall not
be liable or be held responsible whatsoever for loss of data during transaction
or for non-completion of transaction during downtime.
- If Customer inputs the wrong data in the required mandatory fields including a wrong
credit card number or wrong account number, which results in wrongful payment of
a third party's account, Packet One shall not be held liable or responsible whatsoever,
for any losses Customer may suffer.
- Packet One will have the right to recover from the Customer the amount of a transaction
and that amount will be considered a debt due owing to Packet One if:
- the credit card detail was forged or used fraudulently; or
- the authentication of any transaction is disputed; or
- the Customer refuses to make payment to the acquiring bank/issuing bank for any
one transaction for any reasons whatsoever. Without prejudice to the above, Packet
One will have the right to hold back the payment amount which is disputed until
the matter in dispute is resolved.
- Packet One will have the right, without being liable to Customer or any third party
whatsoever, to discontinue, interrupt, withdraw or suspend this credit card payment
service or change any terms and conditions for any period of time that Packet One
considers is appropriate for any reason whatsoever without giving any notification
- Customer agrees that Packet One shall not be liable to the Customer or any other
persons in any way for the use of this payment Services.
- Customer confirms that all the Information is true and valid. Customer gives Packet
One permission to confirm Information from whatever sources that Packet One may
consider appropriate including Inland Revenue, Bank Negara Malaysia and other related
agencies or organizations or institutions or bodies.
- Customer, as the card holder, will be responsible for Customer's balance in the
credit card that Customer uses to make payment to Packet One.
- Customer agrees that any release by Packet One of the Information will not make
Packet One liable to Customer for any claim, loss, damage or liability however it
may arise whether in contract, negligence, or any other basis resulting from or
in relation to
- the release or disclosure of the Information by Packet One; and/or
- the Information being wrong; and/or
- reliance of the Information.
